1. Agreement to Terms

By accessing or using Petition Validator ("the Service"), operated by Victory Waves Co. ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

Petition Validator is a software-as-a-service (SaaS) platform that helps political campaigns and organizations validate petition signatures. The Service includes:

  • AI-powered signature validation and verification
  • Voter file matching and verification
  • Duplicate signature detection
  • Team collaboration and management tools
  • Petition drive management and tracking

3. Account Registration

To use the Service, you must create an account. You agree to:

  • Provide accurate and complete information during registration
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access to your account
  • Be responsible for all activities that occur under your account

4. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to:

  • Use the Service for any fraudulent or illegal purpose
  • Upload false, misleading, or fraudulent data
  • Attempt to gain unauthorized access to the Service or its systems
  • Interfere with or disrupt the Service or servers
  • Reverse engineer or attempt to extract the source code of the Service
  • Use the Service to violate any applicable election laws or regulations
  • Share account credentials with unauthorized parties

5. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of information as described in the Privacy Policy.

You retain ownership of all data you upload to the Service. You grant us a limited license to process your data solely for the purpose of providing the Service. We will not sell or share your data with third parties except as necessary to provide the Service or as required by law.

6. Voter Data Handling

The Service may process voter registration data for the purpose of signature validation. You acknowledge that:

  • You are responsible for ensuring you have the legal right to use any voter data you upload
  • Voter data will be handled in accordance with applicable state and federal laws
  • We implement appropriate security measures to protect voter data
  • You will not use voter data obtained through the Service for purposes other than petition validation

7. Subscription and Payments

Some features of the Service require a paid subscription. By subscribing, you agree to:

  • Pay all applicable fees as described in your subscription plan
  • Provide accurate billing information
  • Authorize recurring charges for subscription renewals unless cancelled

You may cancel your subscription at any time. Cancellation will take effect at the end of your current billing period. We do not provide refunds for partial billing periods.

8. Intellectual Property

The Service and its original content, features, and functionality are owned by Victory Waves Co. and are protected by international copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our express written permission.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

THE SIGNATURE VALIDATION RESULTS PROVIDED BY THE SERVICE ARE FOR INFORMATIONAL PURPOSES ONLY. WHILE WE STRIVE FOR ACCURACY, WE DO NOT GUARANTEE THAT ALL VALIDATION RESULTS WILL BE CORRECT. YOU ARE RESPONSIBLE FOR INDEPENDENTLY VERIFYING PETITION SIGNATURES AS REQUIRED BY APPLICABLE ELECTION LAWS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VICTORY WAVES CO. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless Victory Waves Co. and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising out of your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

12. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease. You may request export of your data within 30 days of termination.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after any changes constitutes acceptance of the new Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be resolved in the state or federal courts located in Delaware.
